Drivers Check Policy: This policy clarifies terminology in multiple job descriptions previously approved by the Collective in connection with hiring searches. It also meets a requirement of our insurance vendor.
List of Policies - Policy Development

This policy applies to all Free Geek employees.

When any job description or other document refers to a “clean,” “safe,” or “acceptable” driving record, this policy should be understood to define the meaning of these or similar terms.

Free Geek is committed to ensuring that all employees perform their duties in a safe and responsible manner. The potential consequences of the unsafe or irresponsible operation of motor vehicles are so serious that it is important for Free Geek to take reasonable precautions with regards to which employees are allowed to do so.

For each employee who is assigned driving duties, or who is expected to be assigned such duties within the next 6 months, Free Geek will order an official Oregon DMV Record for the past three years. Review of this record by HR and the employee's direct supervisor is a necessary precondition for any operation of motor vehicle on Free Geek business.

A single instance of any of the following violations, or similar, will disqualify any employee from operating a motor vehicle on Free Geek business:

  • Operating the vehicle under the influence of alcohol or narcotics (DUI or DWI)
  • Driving with a suspended, revoked or invalid license
  • Reckless driving or negligent driving
  • Drag racing
  • Use of a vehicle to commit a felony
  • Hit and run, leaving the scene of an accident
  • Refusing to stop or fleeing from a law enforcement officer
  • Vehicular homicide or manslaughter

Three or more instances of any of the following violations, or similar, will disqualify any employee from operating a motor vehicle on Free Geek business:

  • Speeding, which can be exceeding a limit or simply driving an unsafe speed
  • Running a stop sign or red traffic light
  • Failure to yield to another vehicle with the right-of-way
  • Failure to signal for turns or lane changes
  • Failing to drive within a single lane
  • Crossing over a center divider, median or gore
  • Driving on the shoulder where it is considered illegal under certain conditions
  • Failure to use a seat belt
  • Failure to stop for a pedestrian in a crosswalk
  • Failure to stop for a school bus when children are boarding or exiting
  • Failure to secure a load to a truck or lorry
  • Driving in a car pool lane illegally
  • Operating a telecommunications device while driving
  • Driving a vehicle outside the conditions of one's license

An employee disqualified from driving on Free Geek business will face disciplinary action up to and including termination if such duties are explicitly included in their job description. Notification of this policy should be included in all offer letters for such positions.

When hiring for positions that explicitly include driving duties in their job descriptions, the DMV Record requirement should be noted in all job postings as a condition of employment.
